These conditions of use describe the conditions under which Rossel & Cie SA grants you access to its website and to the services that it offers there. If certain conditions of use are dealt with more explicitly or in more detail in another regulatory text (for example in the user contract or in the employer contract ('General Conditions') that also applies to you, the provisions of said other text shall prevail over these conditions of use.

 

3. Content and use of websites

As a User, you understand that use of the website or the information contained thereon takes place exclusively at your own risk. The website and all the information that it contains is available 'as is', without any guarantee of any kind.

Rossel & Cie SA makes every reasonable effort to ensure that correct and up-to-date information is provided on the website. When Rossel & Cie SA is notified of the possible presence of errors or inaccuracies on the website, all reasonable means are used to rectify this situation as quickly as possible. In spite of all our efforts, it is possible that some errors and mistakes may persist. In any event, under no circumstances is References.be able to guarantee that the website is up-to-date and does not contain any errors at any time and under any conditions. This is the reason for which - as a User - we recommend that you first check the information with the third party concerned who provides the said information.

References.be may under no circumstances be held liable for any negative consequences that may result from incorrect, inaccurate or missing information or from a lack of clarity on the website References.be or on a referenced third party website. In addition, you accept the fact that the downloading of information or the obtaining of information in any other way whatsoever following use of the website takes place on your initiative and under your responsibility. When we are notified of the presence of possible damaging content on a link, the link in question is immediately examined and if necessary removed.

References.be shall be entitled to modify the information present on the website at any and all times, and consequently to adapt, update or modify the clauses of these conditions. It shall be your responsibility to regularly read through the clauses, conditions, advice and possible additional clauses of the website yourself. If you continue to use the website after the date of entry into force of the said modifications, you shall be deemed to have accepted the said modifications. Moreover, Rossel & Cie SA waives any form of liability for any possible negative consequences that may result from modifications made to the content of the website or of these conditions.

6. Functioning of the website

References.be shall make every effort to ensure that the website is continuously accessible (24 hours a day, 7 days a week) and to protect it using all reasonable means. References.be shall use all reasonable means to limit any inconvenience caused by technical errors to the maximum possible extent. Rossel & Cie SA does not however exclude the possibility that poor technical interventions or unauthorised interventions may take place or that viruses may attack the Site. As a result, References.be is not able to guarantee that access to the website will not be interrupted or that it will not be disrupted in any other way. Consequently, Rossel & Cie SA may not be held liable for any such malfunctions, errors, incidents and problems that may result from any general use whatsoever of the website or of the website of a third party to whom reference is made.   • not to use the website for any illegal purposes, insults that threaten public order or decency or that are intended to tarnish the reputation of Rossel & Cie SA, of the website or of third parties;

If Rossel & Cie SA observes or has good reason to suspect that you have violated any one of the above-mentioned provisions or any other obligations arising from the provisions of the other conditions of use, Rossel & Cie SA shall have the right to refuse you access to the website without prior notice.

Intellectual property rights

You accept and acknowledge that the website may contain software, photos, representations, graphics, drawings, text and any other material (hereinafter referred to as 'the Information') which is protected by the intellectual property rights of Rossel & Cie SA or of third parties. Legality of the conditions of use

The invalidity of one or more clauses of these conditions of use shall in no way affect the validity, applicability and binding character of the other clauses. If one or more clauses are deemed or declared to be invalid based on a law, regulation or final judgement of a competent court, the applicability and scope of the other clauses shall remain intact. Any invalid clause shall in such cases be replaced by another clause that is likely to match the initial objectives of the invalid clause as closely as possible.

The clauses of these conditions of use shall not affect the legal, regulatory or binding provisions and the public policy provisions under Belgian or European law. With regard to the applicability of these conditions of use and their relationship with other legal texts drafted by References.be, we refer you to the provisions of the point above: 2. Area of application.

Applicable law and competent courts

These conditions of use are governed by Belgian law. The user agrees that the courts and tribunals of Brussels shall alone be competent to preside over any disputes concerning the application or interpretation of these conditions of use.
